A 485 visa can lead to permanent residency if you qualify for the general criteria set up, including a minimum of 2 years experience in your nominated occupation.
How long is 485 visa valid for? It depends on the stream. Under the Graduate Work Stream, for example, you could stay up to 18 months or 1 year and 6 months. For 485 visas under the Post-Study Stream, on the other hand, length of stay ranges between 2 to 4 years from the exact date your visa was first granted.
You can bring your partner to Australia by having him or her apply for subclass 485 (subsequent entrant) visa. For your partner’s visa grant, you must provide evidence of genuine relationship that should be no less than one year. Supporting documents that you may attach in your application include email or social media exchanges, photos together, marriage or civil union certificates if married, joint bank accounts and/or loans, and other documents that you think demonstrate your relationship for at least one year from the time of application.
If your 485 visa application is refused, you can file an appeal at the Administrative Appeals Tribunal if you think the decision is incorrect. You must submit your application for appeal no later than 21 days after your visa refusal. You need to be in Australia during the appeals process as well.
Here’s a quick list of mandatory documents you need to submit for your 485 visa application:
• A valid passport and passport-sized photos (35 mm x 45 mm)
• Family and/or Relationship documents
• A duly signed letter confirming you have Health Insurance
• An Australian Federal Police-issued character certificate (must not be older than 12 months)
• Course transcripts (certified copies) and other relevant course completion documents from the education provider
• IELTS result or its equivalent
• For Graduate Work Stream applicants, documents that state your skills have been assessed by an authority and it was confirmed you have the relevant skills needed for your nominated occupation.
Application for a Temporary Graduate visa or Subclass 485 visa can be done twice. It is usually between 1-2 years, depending on the regional location where you graduated and obtained your 485 visa under the post-study work stream.
If you come from a country whose native language is English, such as the UK, USA, and Canada, having taken any English language proficiency exams may not be mandatory. However, international students from other countries are required to take these types of tests to prove you are able to communicate in English in both written and spoken contexts.
Effective 1 July 2023, eligible 485 visa applicants will be automatically granted additional two years to stay in the country. For existing 485 visa holders before 1 July 2023 will have to apply for an extension.
485 visa processing time varies per stream and individual case. Under the Graduate Work stream, for instance, 75% of applications processed are completed within 4 months, while 90% of applications processed for Graduate Work stream visa are completed within 78 days.
