There are eligibility requirements in place before you can be granted (or refused) a temporary or permanent visa.

Also, it is worth noting that besides the criteria set by the Department of Home Affairs, each territory or state in Australia has their individual requirements that all visa candidates must also meet and qualify for. What is the NSW 190 Visa?

The Nominated Skilled Visa under Subclass 190 is a points-based visa that allows skilled migrant workers to obtain a permanent resident status if they are nominated by an Australian state or territory. NSW 190 visa is a state-specific visa for applicants who wish to apply for a state-nominated permanent residency for skilled work purposes in New South Wales.

NSW 190 Requirements and Criteria

To qualify for a 190 NSW visa grant, you must first fulfil the following requirements:

  • You must be no older than 45 years of age.
  • Before applying, you must undergo and qualify for a skills assessment test in an occupation listed under the NSW 190 Occupation List.
  • You must at least attain a “Competent English” result in your IELTS, which means having a score of 6 or more in each component of the test.
  • You must be presently living in New South Wales. The State will not invite Expressions of Interest (EOIs) lodged by people living in another Australian state/territory or those offshore.

With the high volume of applications being received over the years, your goal must be to increase your points to gain an advantage amid the high competition. This involves getting a higher English proficiency test result, finishing a Bachelor’s degree or higher, and gaining relevant work experience that’s included in the skilled occupations list.

NSW Visa 190 Application Process

To make sure you’re on the right track, follow these steps for your NSW visa 190 application process:

Eligibility check

While you could do this by yourself, consider hiring an immigration lawyer or a registered migration agent to give you expert advice and assess your overall eligibility.

EOI Submission

If upon your assessment you are eligible for this visa type, you must now submit an Expression of Interest or EOI to SkillSelect and specify that this is for the NSW nomination.

Receive Invitation

If after checking your EOI and assessing your skills and qualifications you were deemed eligible, you will be invited to apply for 190 visa NSW. Applicants who are skilled in NSW target sectors, such as healthcare, ICT, and education, are prioritised.

Respond within 14 days

You should lodge your application for visa 190 NSW within 14 days after receiving an invitation. Do not forget to submit all the necessary and correct documents.

Waiting game

Usually, NSW 190 visa processing times take about six weeks or more after your payment. Asking for updates on your application is discouraged so as not to compromise the delivery timeline.

NSW 190 Invitation Round 2023

An invitation round is a systematic approach that the Australian Government implements to carefully select migrant workers who will contribute to the country’s skilled workforce and address labour shortages nationwide.

A 190 visa invitation round NSW happens all year round. The nominating authorities do not publicly announce dates as to when they will assess, select, and approve applications. This also means you can submit your EOI anytime within the financial year and not worry about it affecting your chances of being approved or refused a NSW 190 visa.

In addition, careful selection of candidates who submitted their EOIs to be nominated involves an assessment of their English language proficiency and skilled occupation experience.

As previously mentioned, candidates who are applying for occupations that are considered a priority in NSW’s workforce will be prioritised and therefore have better chances of a 190 visa grant, provided they meet all other requirements.

Why is My Application Rejected After Being Nominated?

While being nominated by an Australian State or Territory may give you higher hopes of getting approved for your skilled NSW visa, receiving an invitation alone does not guarantee you a visa grant.

Why may your application still be rejected even after your nomination? The answer lies in the documents you submitted to support the claims you specified in your Expression of Interest. It’s likely that you may have failed to provide substantial evidence that will prove your skilled work experience, residency, and other important qualifications.

Other common reasons for visa application rejections include lack of financial capacity, issues involving character or health, as well as incomplete or bogus documents.
