Meanwhile, those who have submitted their TPV or SHEV application before the said date, and it was still not processed or finalised, it will automatically be converted to a visa 851 application, including any subsequent TPV or SHEV application.
Notably, you are not permitted to apply for an 851 visa if you are barred from doing so. For example, if it is made by an unauthorised maritime arrival. This is stated under Section 46A of the Migration Act 1958.

There is no current data regarding processing times for 851 visas. However, the Department stated that RoS visa applications are being prioritised. Still, individual complexity, volume of applications, and other factors all contribute to how long processing will actually take.
This depends on the nature of your ‘unlawfulness.’
For instance, you can still apply and may be granted an 851 visa if you are currently an unlawful non-citizen because your TPV or SHEV visa has already expired.
